The agreement
between us.

1. Agreement to these Terms
These Terms of Service ("Terms") are an agreement between you and Towup Inc, a Delaware corporation that operates Calypso ("Calypso," "we," "us," or "our"). They cover trycalypso.ai, the Calypso app, and everything we offer through them (together, the "Service").
By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use Calypso.
Our Privacy Policy explains how we handle your information, and our Consumer Health Data Privacy Policy adds the disclosures Washington and Nevada require. Both are part of how the Service works, so please read them too.
2. Who may use Calypso
You must be 18 years of age or older to use Calypso, with or without an account. By using the Service you confirm that you are.
You must also be able to enter into a binding contract, and not be barred from using the Service by the law that applies to you.
If we learn that a user is under 18, we will close the account and delete its personal information, as our Privacy Policy describes.
If a conversation, or your own lines in a chat you upload to Decode, show signs of crisis and signs that the person writing may be under 18, we restrict chat and Decode on that account and on that browser. If you think we got this wrong, email safety@trycalypso.ai.
3. Your account
You can try parts of Calypso without an account. Some features need one.
Please give us accurate information and keep it up to date. One account is for one person.
You are responsible for your account and for what happens in it. Sign-in codes go to your email, so keep your email account secure, and keep any password you set private. If you think someone else has access to your account, tell us at hello@trycalypso.ai.
4. What Calypso is, and what it isn't
Calypso's voices (personas) are artificial intelligence. They are computer programs, not people, and no human is writing their replies.
Calypso is not therapy, medical care, legal advice, financial advice, or a crisis service. It is not a substitute for a licensed professional, and no Calypso voice is, or will claim to be, one.
If you are in immediate danger, call 911 or your local emergency number. In the US and Canada, you can call or text 988 to reach the 988 Suicide & Crisis Lifeline, or text HOME to 741741 to reach the Crisis Text Line. Outside the US, findahelpline.com lists services near you. Our Safety page explains how Calypso responds when a conversation suggests crisis. Calypso cannot call for help on your behalf. No one at Calypso watches conversations as they happen. Our team reads a conversation only in the cases our Privacy Policy describes, such as when our safety system detects signs of crisis.
Decode gives a reading of a moment in a conversation. It is an interpretation, not a verdict about a person.
Astrology readings are for reflection and entertainment. They are not predictions, and they are not a basis for important decisions.
5. AI responses can be wrong
Calypso's responses are generated by AI. They can be inaccurate, incomplete, or out of date. Calypso can misread a screenshot, misunderstand context, or sound more certain than it should.
Please use your own judgement. Do not rely on Calypso alone for decisions about your health, safety, money, legal matters, or relationships. You are responsible for what you decide to do.
6. Free use, Pro subscriptions, renewal and cancellation
Calypso has a free tier with usage limits, and a paid subscription, Calypso Pro, with monthly and yearly plans. What each includes is described on the subscribe page. Limits and features may change over time. Pro also has fair-use limits that keep the Service running for everyone.
Prices. The price of each plan is shown on the subscribe page and at checkout before you pay. The price shown at checkout is the one that applies. Taxes are added at checkout where they apply.
Billing. Payments are processed by our payment processor, Stripe, on its own checkout page. By subscribing, you authorize it to charge your payment method for each billing period.
Automatic renewal. Your subscription renews automatically at the end of each billing period (each month or each year, depending on your plan) and you are charged for the next period, until you cancel. If we change the price of your plan, we will tell you before the new price applies to you, so you can cancel first.
Cancelling. You can cancel at any time from your profile, which opens Stripe's billing page, or by emailing hello@trycalypso.ai. Cancellation takes effect at the end of your current billing period: you keep Pro until then, and you are not charged again.
Failed payments. If a renewal payment fails, Stripe may retry it. If it cannot be collected, your Pro access may end.
Refunds. Except where the law requires otherwise, payments are non-refundable, and we do not give refunds or credits for unused time in a billing period. If you think you were charged in error, email hello@trycalypso.ai.
When we carry out a request to delete your account, any subscription is cancelled at that point.
7. Your content
You keep ownership of what you write and upload to Calypso, such as your messages, screenshots, notes, and comments ("Your Content").
You give Calypso a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit, and display Your Content, only as needed to provide, maintain, and secure the Service for you, and to show what you choose to make public, such as a shared read or a comment. This licence ends when Your Content is deleted, except for copies kept for the periods our Privacy Policy describes (such as backups) and anything you made public that others have already seen.
Other people's messages. Screenshots and chat exports usually include other people's names and messages. When you upload them, you confirm that you have the right to share them with us for this purpose, and that doing so does not break any law or any promise you have made. Do not upload conversations you obtained without permission, such as from someone else's phone.
Shared reads. If you make a read public, you are responsible for that choice. Do not share a read in a way meant to expose, shame, or harass anyone.
Calypso's responses. You may use the responses Calypso gives you for any lawful personal purpose.
8. Acceptable use
Please do not:
use the Service if you are under 18, or help someone under 18 use it;
break the law, or use the Service to help anyone else break it;
harass, threaten, stalk, or intimidate anyone, or publish anyone's private information or messages to expose or shame them;
upload sexual content involving minors, or intimate images of anyone shared without their consent (we report child sexual abuse material as the law requires);
use the Service to plan or encourage harm to yourself or others;
impersonate anyone, or misrepresent your connection to anyone;
post spam, abuse, or advertising in comments on shared reads;
get around usage limits or the paywall, or access the Service by automated means such as bots or scrapers;
copy, resell, or reverse engineer the Service, or use its output to build a competing product or train AI models;
interfere with the Service, overload it, or probe it for security weaknesses (if you find one, please report it responsibly to security@trycalypso.ai).
We may remove content, limit features, or suspend accounts that break these rules.
9. Our intellectual property
The Service, including the Calypso name and logo, the voices and their characters, the website, the app, and the software, belongs to Calypso or its licensors and is protected by law.
We give you a personal, non-transferable, non-exclusive, revocable licence to use the Service for your own non-commercial purposes, in line with these Terms. Nothing else is licensed to you.
If you send us feedback or ideas, we may use them without owing you anything.
10. Third-party services, including YouTube
The Service works with services run by other companies, such as Stripe for payments. Their own terms apply to how you use them, and we are not responsible for them. The same goes for websites the Service links to.
Calypso uses YouTube API Services to publish Calypso's own videos on Calypso's own YouTube channel. YouTube is governed by the YouTube Terms of Service. By using any part of Calypso's services that uses YouTube API Services, you agree to be bound by the YouTube Terms of Service. Google's handling of your data is described in the Google Privacy Policy, and section 16 of our Privacy Policy explains what our publishing tool does and does not access.
11. Suspension and termination
You can stop using Calypso at any time. You can ask to delete your account from your profile, as our Privacy Policy describes.
We may suspend or close your account, or limit what you can do, if you break these Terms, if your use puts other people or the Service at risk, or if the law requires it. Where we can, we will tell you why.
Sections 5, 7 (for content already public), 9, and 12 through 17 continue to apply after your account ends.
12. Disclaimers
To the fullest extent the law allows, the Service is provided "as is" and "as available." We do not promise that it will be uninterrupted, error-free, or secure at every moment, or that its responses will be accurate, complete, or suitable for your purposes. We make no warranties beyond those the law does not let us exclude.
13. Limitation of liability
To the fullest extent the law allows, Calypso will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service.
To the fullest extent the law allows, our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event that gave rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
14. Indemnity
To the extent the law allows, you agree to cover Calypso's reasonable losses and costs from claims by others that arise from Your Content or from your breach of these Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be heard in the state or federal courts located in Delaware, and you and Calypso agree to their jurisdiction.
Before bringing a claim, please email hello@trycalypso.ai and give us 30 days to try to resolve it informally.
If you are a consumer, you keep any protections the law of the place where you live gives you that cannot be waived by contract.
16. Changes to these Terms
We may update these Terms. When we make a material change, we will update the "Last updated" date at the top of this page and tell account holders by email and in-product notice at least 30 days before the change takes effect. If you keep using Calypso after that, the new Terms apply. If you do not agree, you can stop using Calypso and cancel any subscription before the change takes effect.
17. General
These Terms, together with our Privacy Policy and Consumer Health Data Privacy Policy, are the whole agreement between you and Calypso about the Service.
If part of these Terms cannot be enforced, the rest still applies. If we do not enforce a part of these Terms right away, we have not given up the right to enforce it later.
You may not transfer your rights under these Terms to anyone else. We may transfer ours as part of a merger, acquisition, or sale of assets, as our Privacy Policy describes.
